Terms of Service

These Terms of Service ("Terms") govern your use of the Roof City Inc. ("Roof City," "we," "us," or "our") website and any forms, scheduling tools, or communications connected to it. By using our website or submitting a request through it, you agree to these Terms.

Last Updated: [INSERT DATE]
Note: This is a general template intended as a starting point and is not legal advice. It is not a substitute for a licensed attorney's review, particularly for the arbitration, limitation of liability, and governing law sections, which carry real legal consequences and vary by state.
This is not your job contract. These Terms govern use of our website only. Any actual roofing repair or replacement work is governed by a separate, signed written home improvement contract, as required by California law (and the laws of other states where applicable) — including required disclosures such as your right to cancel, itemized pricing, and mechanics lien warnings. Nothing on this website constitutes that contract.

01 Acceptance of Terms

By accessing or using the Roof City website, submitting an inquiry, or scheduling a free inspection through our forms, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website.

02 Description of Services

Our website provides information about Roof City's residential and commercial roofing services, and allows you to request a free roof inspection or estimate. Submitting a request through our website does not create a contract for roofing work — it is a request for us to contact you.

03 Eligibility

You must be at least 18 years old and have the legal authority to request services for the property in question (as an owner, authorized tenant, or property manager) to use our website's forms and scheduling tools.

04 Use of the Website

You agree to use our website only for lawful purposes. You agree not to:

  • Submit false, misleading, or fraudulent information through our forms
  • Attempt to interfere with, disrupt, or gain unauthorized access to our website, servers, or systems
  • Use automated means (bots, scrapers) to access or collect data from our website without our written permission
  • Use our website to transmit any virus, malware, or harmful code
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity

05 Free Inspections & Estimates

Roof City offers free, no-obligation roof inspections as described on our website. Please note:

  • Scheduling an inspection does not obligate you to purchase any service
  • Findings and any preliminary pricing discussed during an inspection are estimates only, based on a visual and/or physical assessment at the time of the visit
  • Final pricing, scope of work, and terms for any roofing project will be set out in a separate written contract, which both parties must sign before work begins
  • We reserve the right to decline to provide a quote or service at our discretion

06 Scheduling & Cancellations

When you schedule an inspection or appointment through our website, we will make reasonable efforts to confirm and honor the requested time. Appointment times are subject to inspector availability and may need to be rescheduled. You may cancel or reschedule an appointment by contacting us directly using the information in Contact Us.

07 Communications & SMS Consent

By submitting your contact information through our website, you consent to be contacted by Roof City Inc. by phone, email, and—where you separately opt in—text message regarding your roofing inquiry, inspection request, appointment scheduling, appointment reminders, estimate and service updates, and, where separately authorized, promotional offers.

  • Message frequency varies.
  • Message and data rates may apply.
  • Reply STOP at any time to opt out.
  • Reply HELP for assistance, or contact Roof City Inc. at (669) 669-3118 or [email protected].
  • Carriers are not liable for delayed or undelivered messages.

For more information, please review our Privacy Policy.

08 Payment & Financing

Pricing, deposits, and payment terms for any roofing project will be specified in your separate written home improvement contract. If financing is discussed, financing (where available) is provided by independent third-party lending partners, subject to credit approval and the lender's own terms. Roof City is not the lender and does not guarantee financing approval or specific rates.

09 Intellectual Property

The Roof City name, logo, website design, and content (text, graphics, and images) are the property of Roof City Inc. or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, or use our branding or website content without our prior written permission.

10 Third-Party Services & Links

Our website uses third-party tools to operate, including a customer relationship management and scheduling platform (GoHighLevel), advertising and analytics platforms (e.g., Meta/Facebook, Google), and may link to third-party sites such as financing partners or review platforms. We are not responsible for the content, accuracy, or practices of third-party services or websites.

11 Disclaimers of Warranties

Our website and its content are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure. Any warranties applicable to actual roofing work performed will be set out separately in your written home improvement contract or applicable manufacturer warranties.

12 Limitation of Liability

To the fullest extent permitted by law, Roof City Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, even if we have been advised of the possibility of such damages. Nothing in these Terms is intended to limit liability that cannot be limited under applicable law.

13 Indemnification

You agree to indemnify and hold harmless Roof City Inc. and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of our website, violation of these Terms, or violation of any rights of a third party.

14 Dispute Resolution & Arbitration

ARBITRATION OF DISPUTES. THE PARTIES AGREE THAT ANYAND ALL DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO THIS AGREEMENT,OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THERE OF, INCLUDING THE DETERMINATION OF THE SCOPE OR APPLICABILITY OF THIS ARBITRATION PROVISION, SHALL BE DETERMINED EXCLUSIVELY BY BINDING ARBITRATION. THE ARBITRATION SHALL BE CONDUCTED IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION ("AAA") OR ANOTHER MUTUALLY AGREED-UPON ARBITRATION SERVICE, AND IT SHALL TAKE PLACE IN THE COUNTY WHERE THE WORK WAS PERFORMED UNLESS OTHERWISE AGREED IN WRITING. EITHER PARTY MAY INITIATE ARBITRATION BY PROVIDING WRITTEN NOTICE TO THE OTHER PARTY AND FILING A DEMAND FOR ARBITRATION WITH THE SELECTED ARBITRATION SERVICE. THE ARBITRATION SHALL BE CONDUCTED BY A SINGLE ARBITRATOR UNLESS THE AMOUNT IN DISPUTE EXCEEDS $250,000, IN WHICH CASE A PANEL OF THREE ARBITRATORS SHALL BE USED. THE ARBITRATOR(S) SHALL BE NEUTRAL AND IMPARTIAL AND SHALL BE SELECTED IN ACCORDANCE WITH THE APPLICABLE RULES OF THE ARBITRATION SERVICE. NOT WITHSTANDING THE ABOVE, EITHER PARTY RETAINS THE RIGHT TO BRING A CLAIM IN SMALL CLAIMS COURT IN THE COUNTY WHERE THE WORK WAS PERFORMED IF THE CLAIM IS WITHIN THE MONETARY LIMITS OF THE SMALL CLAIMS COURT’S JURISDICTION. FILING A CLAIM IN SMALL CLAIMS COURT DOES NOT WAIVE THE RIGHT TO ARBITRATE, PROVIDED THAT ANY CLAIMS FOR DAMAGES EXCEEDING THE JURISDICTIONAL LIMIT OF THE SMALL CLAIMS COURT SHALL BE RESOLVED THROUGH ARBITRATION IN ACCORDANCE WITH THIS PROVISION. THE PARTIES AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT ON A CLASS, COLLECTIVE, OR REPRESENTATIVE BASIS, AND EXPRESSLY WAIVE THEIR RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION OR COLLECTIVE ARBITRATION. EITHER PARTY MAY SEEK PRELIMINARY OR PROVISIONAL RELIEF, SUCH AS AN INJUNCTION OR RESTRAINING ORDER, FROM A COURT OF COMPETENT JURISDICTION AS NECESSARY TO PROTECT ITS RIGHTS OR PROPERTY PENDING THE OUTCOME OF THE ARBITRATION. THE AWARD OF THE ARBITRATOR(S) SHALL BE FINAL AND BINDING ON THE PARTIES AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION. THE ARBITRATOR(S) SHALL HAVE THE AUTHORITY TO AWARD COSTS AND FEES, INCLUDING ATTORNEYS' FEES, TO THE PREVAILING PARTY IN ACCORDANCE WITH APPLICABLE LAW. THE PARTIES AGREE THAT THE ARBITRATION AWARD MAY BE CHALLENGED OR APPEALED ONLY ON THE GROUNDS OF FRAUD, CORRUPTION, OR OTHER UNDUE MEANS, OR WHERE THE ARBITRATOR(S) EXCEEDED THEIR POWERS OR FAILED TO RENDER A DECISION IN ACCORDANCE WITH APPLICABLE LAW. BY AGREEING TO ARBITRATION, THE PARTIES WAIVE THEIR RIGHT TO A JURY TRIAL FOR ANY DISPUTE COVERED BY THIS PROVISION, ACKNOWLEDGING THAT ARBITRATION IS INTENDED TO PROVIDE A MORE EFFICIENT AND COST-EFFECTIVE METHOD OF RESOLVING DISPUTES THAN LITIGATION. IF ANY PORTION OF THIS ARBITRATION PROVISION IS FOUND TO BE UNENFORCEABLE OR INVALID BY A COURT OF COMPETENT JURISDICTION, THE REMAINDER OF THIS PROVISION SHALL REMAIN IN FULL FORCE AND EFFECT, WITH THE UNENFORCEABLE OR INVALID PORTION SEVERED. THIS ARBITRATION PROVISION SHALL SURVIVE THE TERMINATION OR EXPIRATION OF THIS AGREEMENT AND CONTINUE TO BIND THE PARTIES WITH RESPECT TO ANY DISPUTE ARISING OUT OF OR RELATING TO THIS AGREEMENT.

15 Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles, unless otherwise required by the law of the state in which you reside.

16 Home Improvement Contract Notice

Any actual roof repair, replacement, or installation work is governed exclusively by a separate written home improvement contract signed by both you and Roof City Inc., prepared in accordance with California's home improvement contract laws (and those of other applicable states). That contract will include legally required disclosures such as, where applicable, your three-day right to cancel a home solicitation contract, itemized pricing, payment schedules, and mechanics lien warnings. These website Terms do not replace, modify, or substitute for that contract.

17 Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of our website after changes are posted constitutes acceptance of the updated Terms.
